Comelec appeals SC ruling on Poe

MANILA ― The Commission on Elections (Comelec) has appealed before the Supreme Court (SC) to reconsider its ruling that allowed Senator Grace Poe to run for president in the May 9 national elections.


In a 59-page motion for reconsideration (MR), the Comelec asked the High Court to reconsider its ruling on Poe's disqualification case.


The Comelec argued that no grave abuse of discretion was committed when it cancelled the certificate of candidacy (CoC) for president of Poe in the May 9, 2016 elections.


It filed the motion for reconsideration anchored on the citizenship issue of Poe.


The Comelec also asked the SC to "re-deliberate" on its ruling on the Poe case due to lack of majority.


It invoked Section 2 of Rule 12 of the Internal Rules of Court which provides for a majority vote of eight votes in a decision with 15 magistrates.


The Comelec further argued that if majority is still not attained after re-vote, "We seek SC to dismiss the Poe case."


It noted that the SC voted 7-5-3 on the Poe citizenship issue, thus calling for re-deliberation as it is not a majority vote.


"If required majority is still not attained, then we are asking the court to dismiss the case," the Comelec said.
